What this site is, and is not.

1. Who runs this site

This website is operated by Mehmet Burak Dikmen, trading as fspark9, Berlin, Germany. Full details are in the legal notice.

By using the site you accept these terms. If you do not, please do not use it.

2. What this site is

A description of a consulting practice and the work behind it. It exists so you can decide whether to have a conversation with me. That is its entire purpose.

3. Business users only

This site and the services described on it are addressed to businesses, that is to entrepreneurs within the meaning of § 14 of the German Civil Code. They are not offered to consumers, and I do not conclude contracts with consumers. Provisions of German and EU consumer law that assume a consumer counterparty, including the statutory right of withdrawal, do not apply.

If you are acting as a private individual rather than on behalf of a business, this site is not for you.

4. Nothing here is advice

Nothing on this site is legal advice, regulatory advice, tax advice, investment advice, or a recommendation to enter into any transaction, partnership, licence application, or product launch. I am a consultant. I am not a lawyer, not a tax adviser, and not a licensed financial adviser in any jurisdiction.

Financial services regulation differs by country, changes often, and turns on facts specific to your business. A statement that is accurate for one company in Germany may be wrong for yours in the UK, and may be wrong for both a year from now. Before acting on anything you read here, take advice from a qualified professional who knows your situation.

Reading this site does not create a client relationship, a duty of care, or a contract between us. That happens only when we both sign an engagement letter.

5. Case studies and results

The case studies describe work I did in roles I held at the time, in each case as part of a team inside the organisation concerned. They describe my own contribution and no more than that.

Figures such as user growth, funding raised, and market entry are taken from public sources, which are cited on the relevant pages. They describe what those businesses achieved, in their market, at that time. They are not a forecast, and they are not a promise of what your business will achieve. No two markets, teams, regulators, or timings are alike.

Nothing on this site is confidential to any current or former employer or client. Everything published here is either publicly available or has been cleared for publication.

6. Third party names and marks

insha, RUUT, İşbank, Turkcell, Paycell, Financell, Albaraka, solarisBank, Mastercard, and any other company or product names appearing on this site are the trademarks of their respective owners.

They appear here for one reason only: to identify accurately where I held a role and what work I did there. They are used descriptively, not as an indication of origin.

Their appearance does not mean any of these organisations is a client of fspark9, has any current relationship with fspark9, or endorses, sponsors, or approves fspark9 or anything on this site. I claim no rights in their marks.

If you are a rights holder and you object to how your name appears here, write to me at the address in the legal notice and I will address it.

7. Accuracy

I try to keep the site accurate and current, but I do not warrant that it is. Markets, regulation, and provider capabilities move faster than website copy. Content may be changed or removed at any time without notice.

8. Intellectual property

The text, structure, design, brand name, logo, and case study writing on this site belong to me unless marked otherwise. You may read it, quote it with attribution, and link to it. You may not reproduce it in bulk, republish it as your own, or use it to train a commercial model without written permission.

The name fspark9 and the fspark9 logo are my marks.

9. Links to other sites

Links to third party sites are provided because they are useful. I do not control those sites and I am not responsible for their content, their accuracy, or what they do with your data. They were relevant when I linked them. That may no longer be true.

10. Availability

The site is provided as it is, with no guarantee that it will be available, uninterrupted, or free of errors. I may take it offline, change it, or stop publishing it at any time.

11. Liability

Nothing in these terms limits my liability for intent or gross negligence, for death or personal injury caused by negligence, for fraudulent misrepresentation, or for anything else that cannot lawfully be limited under German law.

Subject to that, I am not liable for any loss arising from your use of this site or from reliance on anything published here. This includes lost profit, lost revenue, lost opportunity, wasted expenditure, and regulatory or contractual consequences.

Liability arising from an actual engagement is governed by the engagement letter and the general terms of business agreed there, not by this page.

12. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. The courts of Berlin have exclusive jurisdiction, to the extent such an agreement is permitted.

13. Severability

If any part of these terms is found invalid, the rest stays in force.

14. Changes

These terms may be updated. The version published at the time you use the site is the one that applies. The date at the top shows when it last changed.
